1. Agreement to Terms

By accessing or using the Lanzando Piedra website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

These Terms of Service apply to all users of the site, including without limitation users who are browsers, customers, and/or contributors of content.

2. Description of Services

Lanzando Piedra provides online baseball pitching coaching services, including but not limited to:

• Video analysis and feedback on pitching mechanics
• Direct messaging with coaches
• Personalized training plans and programs
• One-on-one coaching sessions
• Access to educational content and resources
• Community features and updates

3. Account Registration

To access certain features of our services, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these terms or contain false information.

4. Subscription and Payments

Subscription Plans

We offer various subscription plans with different features and pricing. Plan details, including pricing and features, are displayed on our website and may be updated from time to time.

Billing

Subscription fees are billed in advance on a recurring monthly basis. You authorize us to charge your payment method on file for all applicable fees. All payments are processed securely through Stripe.

Free Trials

We may offer free trial periods for certain subscription plans. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to your subscription features until the end of your current billing period. No refunds will be provided for partial months.

5. User Content

Your Content

You retain ownership of any content you submit, post, or display through our services, including videos, messages, and profile information ("User Content"). By uploading User Content, you grant us a limited license to use, store, and display that content for the purpose of providing our services.

Content Guidelines

You agree not to upload or share content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Infringes on any third party's intellectual property rights
• Contains viruses or malicious code
• Is spam or unsolicited promotional material
• Violates any applicable laws or regulations

Video Content

Videos uploaded for coaching analysis are private and will only be viewed by your assigned coach and Lanzando Piedra staff as necessary to provide services. We will not share your videos publicly without your explicit consent.

6. Coaching Services Disclaimer

Our coaching services are provided for informational and educational purposes. While our coaches are experienced professionals, please note:

• Coaching advice is not a substitute for professional medical advice
• You should consult with a physician before starting any new training program
• Results may vary based on individual effort, ability, and physical condition
• You participate in training activities at your own risk
• We are not responsible for any injuries that may occur during training

7. Intellectual Property

The Lanzando Piedra website, logo, brand, and all content created by us (excluding User Content) are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Reverse engineer or attempt to extract source code from our platform
• Remove any copyright or proprietary notices from our materials

8. Limitation of Liability

To the maximum extent permitted by law, Lanzando Piedra and its owner, Eli Garcia, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or other intangible losses
• Personal injury or property damage related to your use of our services
• Unauthorized access to or alteration of your data
• Any third-party conduct on our platform

Our total liability shall not exceed the amount you paid for our services in the twelve (12) months preceding the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless Lanzando Piedra, its owner, and affiliates from any claims, damages, losses, or expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.

10. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice, for any reason, including but not limited to:

• Breach of these Terms of Service
• Fraudulent or illegal activity
• Failure to pay subscription fees
• Behavior that is harmful to other users or our business

Upon termination, your right to use our services will cease immediately. Provisions of these terms that should survive termination will remain in effect.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of New Jersey.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will provide notice of significant changes by posting the updated terms on our website and updating the "Last updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
